Selling food from stalls & local markets
If you sell food from a stall or you are organising an event where food will be sold, find out about the food safety requirements that apply.
A stall includes any movable stand, mobile shop, road vehicle or fishing vessel at, or from which food is sold.
Meeting requirements
The legislation you operate under when you run a stall depends on the food you are selling. The main legislation is:
- the Food Act 1981 – this means you operate under the Food Hygiene Regulations 1974 or have an audited Food Safety Programme (FSP)
- the Animal Products Act 1999, which applies, for example, if you are a dual operator butcher selling regulated retail meat
- the Wine Act 2003, which applies if you manufacture and trade in wine.
Whatever food you sell, you also need to comply with the Australia New Zealand Food Standards Code (the Code).

Labelling food
If you sell food from a stall or at a market, you need to ensure your food meets the composition and labelling requirements of the Australia New Zealand Food Standards Code (The Code).
For example:
- you must not sell food beyond its 'Use by' date
- when you name a food there are sometimes certain requirements around the ingredients and their amounts
- if you are selling a food and a customer asks if a particular ingredient is in it, you must be able to tell them.
